Es pot utilitzar per:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Despeses urgents:<\/strong> Avaries que paren un servei (ascensor, calefacci\u00f3, bomba d&#8217;aigua)<\/li>\n\n\n\n<li><strong>Obres extraordin\u00e0ries:<\/strong> Reformes de conservaci\u00f3, rehabilitaci\u00f3 o millora de l&#8217;edifici<\/li>\n<\/ul>\n\n\n\n<p>Els diners es guarden en un compte bancari separat a nom de la comunitat i queden lligats a ella de forma permanent.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quant heu de guardar<\/h2>\n\n\n\n<p>La llei obliga a dotar el fons de reserva amb un <strong>m\u00ednim del 5%<\/strong> de les despeses comunes pressupostades anualment.<\/p>\n\n\n\n<p><strong>Exemples:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pressupost anual 12.000 \u20ac \u2192 M\u00ednim a guardar: 600 \u20ac<\/li>\n\n\n\n<li>Pressupost anual 24.000 \u20ac \u2192 M\u00ednim a guardar: 1.200 \u20ac<\/li>\n<\/ul>\n\n\n\n<p><strong>Punts claus:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Els diners pertanyen a tots els propietaris per\u00f2 queden vinculats a la comunitat<\/li>\n\n\n\n<li>Si vendes el pis, no recuperes la teva part del fons<\/li>\n\n\n\n<li>Els estalvis no gastats cada any s&#8217;acumulen al fons seg\u00fcent<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Quan es pot gastar i qui ho decideix<\/h2>\n\n\n\n<p><strong>Per a urg\u00e8ncies:<\/strong> L&#8217;administrador amb l&#8217;autoritzaci\u00f3 del president pot gastar del fons sense junta previa.<\/p>\n\n\n\n<p><strong>Per a obres grans:<\/strong> La junta de propietaris ha d&#8217;aprovar l&#8217;\u00fas del fons en reuni\u00f3.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Exemple pr\u00e0ctic<\/h2>\n\n\n\n<p>Imagina&#8217;t una comunitat amb pressupost anual de 12.000 \u20ac:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Any 1:<\/strong> S&#8217;aparten 600 \u20ac al fons (5% de 12.000)<\/li>\n\n\n\n<li><strong>Urg\u00e8ncia:<\/strong> L&#8217;ascensor es trenca. Reparaci\u00f3: 500 \u20ac. El president autoritza pagar-la del fons<\/li>\n\n\n\n<li><strong>Final d&#8217;any:<\/strong> Queden 100 \u20ac (600 &#8211; 500). Aquests 100 \u20ac es sumen al fons del any seg\u00fcent<\/li>\n\n\n\n<li><strong>Any 2:<\/strong> Fons inicial = 600 \u20ac + 100 \u20ac = 700 \u20ac<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">Ve\u00efns que no paguen<\/h2>\n\n\n\n<p>La contribuci\u00f3 al fons de reserva \u00e9s obligat\u00f2ria per a tots els propietaris segons la seva quota de participaci\u00f3.<\/p>\n\n\n\n<p>Si un propietari no paga:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Entra en mor\u00f3s de deute<\/li>\n\n\n\n<li>La comunitat pot reclamar-lo per proc\u00e9s monitori<\/li>\n\n\n\n<li>Perd el dret a vot en les reunions de la junta<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"que-diu-exactament-la-llei-respecte-a-les-juntes-de-propietaris\">Qu\u00e8 diu exactament la llei respecte al fons de la comunitat?<\/h2>\n\n\n\n<blockquote class=\"wp-block-quote is-style-default has-small-font-size is-layout-flow wp-block-quote-is-layout-flow\" style=\"margin-top:0;margin-bottom:0\">\n<p><strong><a href=\"https:\/\/portaljuridic.gencat.cat\/ca\/document-del-pjur\/?documentId=422359#1074669\" target=\"_blank\" rel=\"noreferrer noopener\">Article 553-6 Fons de reserva<\/a><\/strong><\/p>\n\n\n\n<p><strong>1. En el pressupost de la comunitat ha de figurar una quantitat no inferior al 5% de les despeses<\/strong><\/p>\n\n\n\n<p><strong>comunes destinada a la constituci\u00f3 d\u2019un fons de reserva.<\/strong><\/p>\n\n\n\n<p><strong>2. La titularitat del fons de reserva \u00e9s de tots els propietaris i el fons resta afectat a la comunitat sense<\/strong><\/p>\n\n\n\n<p><strong>que cap propietari tingui dret a reclamar-ne el retorn en el moment de l\u2019alienaci\u00f3 de l\u2019element privatiu.<\/strong><\/p>\n\n\n\n<p><strong>3. El fons de reserva ha de figurar en comptabilitat separada i s\u2019ha de dipositar en un compte bancari<\/strong><\/p>\n\n\n\n<p>especial a nom de la comunitat. Els administradors nom\u00e9s en poden disposar, amb l\u2019autoritzaci\u00f3 de la<\/p>\n\n\n\n<p>presid\u00e8ncia, per a atendre despeses de la comunitat imprevistes de car\u00e0cter urgent o, amb l\u2019autoritzaci\u00f3<\/p>\n\n\n\n<p>de la junta de propietaris, per a fer front a les obres extraordin\u00e0ries de conservaci\u00f3, reparaci\u00f3,<\/p>\n\n\n\n<p>rehabilitaci\u00f3, instal\u00b7laci\u00f3 de nous serveis comuns i seguretat, i tamb\u00e9 per a les que siguin exigibles<\/p>\n\n\n\n<p>d\u2019acord amb les normatives especials.<\/p>\n\n\n\n<p>4. Els romanents del fons de reserva de cada any s&#8217;acumulen en el fons de l\u2019any seg\u00fcent.<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"t\"><a
