Per modificar-los es requereix el vot favorable de <strong>quatre cinquenes parts (4\/5)<\/strong> dels propietaris i que aquests representin les quatre cinquenes parts de les quotes de participaci\u00f3, amb la excepci\u00f3 de la modificaci\u00f3 de les quotes de participaci\u00f3, que requereix unanimitat i el <strong>consentiment expr\u00e9s<\/strong> dels propietaris afectats.<\/p>\n\n\n\n<p><strong>Nota:<\/strong> Els estatuts no inscrits en el Registre de la Propietat nom\u00e9s vinculen propietaris que ho-eren en el moment de l&#8217;aprovaci\u00f3.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"que-poden-regular-els-estatuts\">Qu\u00e8 Poden Regular els Estatuts<\/h2>\n\n\n\n<p>Els estatuts de comunitat determinen:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u00das d&#8217;elements privatius i comuns:<\/strong> destinaci\u00f3 dels pisos i espais compartits (jardins, escales, ascensors)<\/li>\n\n\n\n<li><strong>Limitacions de les propietats privades:<\/strong> activitats permeses dins dels pisos<\/li>\n\n\n\n<li><strong>Distribuci\u00f3 de despeses:<\/strong> quota de participaci\u00f3 i repartiment de costos<\/li>\n\n\n\n<li><strong>Govern i administraci\u00f3:<\/strong> estructura interna, \u00f2rgans de decisi\u00f3 i funcions del gestor<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"clausules-estatutaries-utils-mes-comunes\">Cl\u00e0usules Estatut\u00e0ries \u00datils M\u00e9s Comunes<\/h2>\n\n\n\n<p>Els estatuts permeten incloure disposicions espec\u00edfiques per optimitzar la gesti\u00f3 comunit\u00e0ria:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Exoneraci\u00f3 de despeses:<\/strong> Eximir propietaris de costos de conservaci\u00f3 d&#8217;elements que no utilitzen (ascensor, jard\u00ed, piscina)<\/li>\n\n\n\n<li><strong>\u00das exclusiu d&#8217;espais comuns:<\/strong> Assignar a un propietari l&#8217;\u00fas exclusiu de coberta, soterrani o jard\u00ed<\/li>\n\n\n\n<li><strong>Operacions immobili\u00e0ries:<\/strong> Facilitar agrupaci\u00f3 i divisi\u00f3 de pisos sense aprovaci\u00f3 de la junta<\/li>\n\n\n\n<li><strong>Publicitat en fa\u00e7ana:<\/strong> Autoritzar cartells publicitaris en locals comercials<\/li>\n\n\n\n<li><strong>Resoluci\u00f3 de conflictes:<\/strong> Establir Interior<\/h2>\n\n\n\n<p>Sovint es confonen aquests documents, per\u00f2 tenen funcions diferents:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table (quotes, \u00fas de terrats)<\/td><td>Estableixen regles de conviv\u00e8ncia i bon ve\u00efnatge<\/td><\/tr><tr><td>Constitueixen la norma superior de la comunitat<\/td><td>Complementa els estatuts i no pot contredir-los<\/td><\/tr><tr><td>Requereixen 4\/5 de vots per modificar-se<\/td><td>Es modifica per majoria simple<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"que-estableix-la-llei-sobre-els-estatuts\">Qu\u00e8 Estableix la Llei Sobre els Estatuts<\/h2>\n\n\n\n<p>Segons l&#8217;<strong>Article 553-11 del Codi Civil de Catalunya<\/strong>, els estatuts poden regular:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Destinaci\u00f3, \u00fas i aprofitament d&#8217;elements privatius i comuns<\/li>\n\n\n\n<li>Limitacions d&#8217;\u00fas i c\u00e0rregues de les propietats<\/li>\n\n\n\n<li>Exercici de drets i obligacions dels propietaris<\/li>\n\n\n\n<li>Distribuci\u00f3 de despeses i beneficis<\/li>\n\n\n\n<li>\u00d2rgans complementaris de govern i compet\u00e8ncies<\/li>\n\n\n\n<li>Sistema de gesti\u00f3 i administraci\u00f3<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">Cl\u00e0usules V\u00e0lides Segons la Llei<\/h3>\n\n\n\n<p>El Codi Civil de Catalunya autoritza expl\u00edcitament:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Divisi\u00f3, agrupaci\u00f3 i segregaci\u00f3 de pisos sense consentiment de la junta<\/li>\n\n\n\n<li>Exempci\u00f3 de despeses de conservaci\u00f3 d&#8217;elements comuns espec\u00edfics<\/li>\n\n\n\n<li>\u00das exclusiu i tancat de parts del solar, cobertes o elements comuns<\/li>\n\n\n\n<li>Publicitat en fa\u00e7ana o altres elements comuns<\/li>\n\n\n\n<li>Limitaci\u00f3 d&#8217;activitats en elements privatius<\/li>\n\n\n\n<li>Resoluci\u00f3 de conflictes mitjan\u00e7ant arbitratge o mediaci\u00f3<\/li>\n<\/ul>\n\n\n\n<p><strong>Important:<\/strong> \u00ab<em>Les normes dels estatuts que no siguin inscrites en el Registre de la Propietat <\/em><strong>no perjudiquen tercers de bona fe<\/strong><em>\u00ab<\/em>. Aix\u00f2 vol dir que si un comprador nou adquireix el pis i no coneixia els estatuts perqu\u00e8 no estaven al Registre, no li seran aplicables.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"consells-practics\">Consells Pr\u00e0ctics<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Revisa regularment els teus estatuts per estar al dia de les teves obligacions<\/li>\n\n\n\n<li>Diferencia clarament entre estatuts i reglament de r\u00e8gim interior<\/li>\n\n\n\n<li>Consulta amb l&#8217;advocat de la comunitat en cas de dubte sobre l&#8217;aplicaci\u00f3 dels estatuts<\/li>\n\n\n\n<li>Conserva una c\u00f2pia dels estatuts inscrits al Registre de la Propietat<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"que-diu-exactament-la-llei-respecte-a-les-juntes-de-propietaris\">Qu\u00e8 diu exactament la llei respecte al fons de la comunitat?<\/h2>\n\n\n\n<blockquote class=\"wp-block-quote is-style-default has-small-font-size is-layout-flow wp-block-quote-is-layout-flow\" style=\"margin-top:0;margin-bottom:0\">\n<p><em><a href=\"https:\/\/portaljuridic.gencat.cat\/ca\/document-del-pjur\/?documentId=422359#1074675\" target=\"_blank\" rel=\"noreferrer noopener\">Article 553-11 Estatuts<\/a><\/em><\/p>\n\n\n\n<p><strong>1. Els estatuts regulen els aspectes referents al r\u00e8gim jur\u00eddic real de la comunitat i poden contenir regles<\/strong><\/p>\n\n\n\n<p>sobre les q\u00fcestions seg\u00fcents:<\/p>\n\n\n\n<p>a) La destinaci\u00f3, l\u2019\u00fas i l\u2019aprofitament dels elements privatius i dels elements comuns.<\/p>\n\n\n\n<p>b) Les limitacions d\u2019\u00fas i altres c\u00e0rregues dels elements privatius.<\/p>\n\n\n\n<p>c) L\u2019exercici dels drets i el compliment de les obligacions.<\/p>\n\n\n\n<p>d) L\u2019aplicaci\u00f3 de despeses i ingressos i la distribuci\u00f3 de c\u00e0rregues i beneficis.<\/p>\n\n\n\n<p>e) Els \u00f2rgans de govern complementaris dels que estableix aquest codi i llurs compet\u00e8ncies.<\/p>\n\n\n\n<p>f) La forma de gesti\u00f3 i administraci\u00f3.<\/p>\n\n\n\n<p>2. S\u00f3n v\u00e0lides les cl\u00e0usules estatut\u00e0ries seg\u00fcents, entre d\u2019altres:<\/p>\n\n\n\n<p>a) Les que permeten les operacions d\u2019agrupaci\u00f3, agregaci\u00f3, segregaci\u00f3 i divisi\u00f3 d\u2019elements privatius i les<\/p>\n\n\n\n<p>de desvinculaci\u00f3 d\u2019annexos amb creaci\u00f3 de noves entitats sense consentiment de la junta de propietaris.<\/p>\n\n\n\n<p>En aquest cas, les quotes de participaci\u00f3 de les finques resultants es fixen per la suma o la distribuci\u00f3 de<\/p>\n\n\n\n<p>les quotes dels elements privatius afectats.<\/p>\n\n\n\n<p>b) Les que exoneren determinats propietaris d\u2019elements privatius de l\u2019obligaci\u00f3 de satisfer les despeses<\/p>\n\n\n\n<p>de conservaci\u00f3 d\u2019elements comuns concrets, que poden incloure les del portal, l\u2019escala, els ascensors, els<\/p>\n\n\n\n<p>jardins, les zones d\u2019esbarjo i altres espais semblants.<\/p>\n\n\n\n<p>c) Les que estableixen la utilitzaci\u00f3 exclusiva i, si escau, el tancament d\u2019una part del solar, o de les<\/p>\n\n\n\n<p>cobertes o de qualsevol altre element com\u00fa o part determinada d\u2019aquest en favor d\u2019algun element<\/p>\n\n\n\n<p>privatiu.<\/p>\n\n\n\n<p>d) Les que permeten l\u2019\u00fas o el gaudi d\u2019elements comuns per mitj\u00e0 de la col\u00b7locaci\u00f3 de cartells de<\/p>\n\n\n\n<p>publicitat.<\/p>\n\n\n\n<p>e) Les que limiten les activitats que es poden acomplir en els elements privatius.<\/p>\n\n\n\n<p>f) Les que preveuen la resoluci\u00f3 dels conflictes per mitj\u00e0 de l\u2019arbitratge o la mediaci\u00f3 per a qualsevol<\/p>\n\n\n\n<p>q\u00fcesti\u00f3 del r\u00e8gim de la propietat horitzontal.<\/p>\n\n\n\n<p>3. Les normes dels estatuts que no siguin inscrites en el Registre de la Propietat no perjudiquen tercers<\/p>\n\n\n\n<p>de bona fe.<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"t\"><a
