Segons l&#8217;article 553-19.2.a del Codi Civil de Catalunya, t\u00e9 la **compet\u00e8ncia exclusiva** per al nomenament i la remoci\u00f3 de les persones que ocupen els c\u00e0rrecs de la comunitat, incl\u00f2s l&#8217;administrador.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Autoritat de la Junta per cessar l&#8217;administrador<\/h3>\n\n\n\n<p>La Junta de Propietaris pot cessar l&#8217;administrador en qualsevol moment, ja que aquest \u00e9s responsable de la seva actuaci\u00f3 directament davant d&#8217;ella. No cal esperar a que venci el seu contracte ni \u00e9s necessari demostrar causa justificada si es compleix la majoria legal requerida. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Execuci\u00f3 obligat\u00f2ria de l&#8217;acord de <strong>cessament<\/strong><\/h3>\n\n\n\n<p>L&#8217;administrador no es pot oposar al cessament acordat per la Junta. Un cop votat i aprovat per majoria simple, l&#8217;acord \u00e9s obligatori, vinculant i executiu per a tots els propietaris, incl\u00f2s els que votaren en contra o estaven absents de la reuni\u00f3. <\/p>\n\n\n\n<p>No obstant, at\u00e8s que es tracta d&#8217;una relaci\u00f3 contractual per a la prestaci\u00f3 de serveis professionals, si existeix un contracte privat amb una durada pactada i es rescindeix sense una \u00abjusta causa\u00bb (com neglig\u00e8ncia o incompliment de funcions), l&#8217;administrador podria reclamar els honoraris corresponents al temps que resti de contracte o la indemnitzaci\u00f3 pactada en aquest document.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Com convocar la reuni\u00f3<\/h2>\n\n\n\n<p>Per cessar l&#8217;administrador, cal celebrar una reuni\u00f3 (ordin\u00e0ria o extraordin\u00e0ria) on la remoci\u00f3 figuri<br>expressament en l&#8217;ordre del dia. Una convocat\u00f2ria gen\u00e8rica o amb menci\u00f3 a \u00abassumptes varis\u00bb pot ser<br>impugnada com a nul\u00b7la.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Qui pot convocar la junta<\/h3>\n\n\n\n<p>Habitualment, el president de la comunitat \u00e9s qui convoca la junta. No obstant aix\u00f2, si el president<br>es nega a fer-ho o est\u00e0 inactiu, <strong>vicepresid\u00e8ncia<\/strong> o <strong>la quarta part dels propietaris<\/strong> o aquells que representin<br><strong>una quarta part de les quotes de participaci\u00f3<\/strong> pot promoure la reuni\u00f3 de forma legal.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Termini legal de notificaci\u00f3<\/h3>\n\n\n\n<p>La convocat\u00f2ria s&#8217;ha de trametre amb un <strong>m\u00ednim de vuit dies naturals d&#8217;antelaci\u00f3<\/strong> a l&#8217;adre\u00e7a comunicada pel propietari a la comunitat. Els vuit dies es compten de forma natural (inclosos festius i caps de setmana). Si es tracta de junta extraordin\u00e0ria urgent, no hi ha un termini minim. <\/p>\n\n\n\n<p><strong>Exemple:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Convocat\u00f2ria notificada: 5 de gener<\/li>\n\n\n\n<li>Primer dia de c\u00f2mput: 6 de gener<\/li>\n\n\n\n<li>Data m\u00ednima de junta: 14 de gener (exactament 9 dies = legal)<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Majoria necess\u00e0ria per al cessament<\/h2>\n\n\n\n<p>L&#8217;acord de remoci\u00f3 de l&#8217;administrador s&#8217;adopta per <strong>majoria simple<\/strong>, que \u00e9s la m\u00e9s baixa de les<br>majories legals. Aix\u00f2 significa que \u00e9s m\u00e9s f\u00e0cil cessar un administrador que prendre altres decisions<br>comunit\u00e0ries que requereixen majoria qualificada.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Com es calcula la majoria simple<\/h3>\n\n\n\n<p>La majoria simple s&#8217;assoleix quan els <strong>vots i les cuotes de participaci\u00f3 a favor superen<\/strong> els vots<br>i les cuotes en contra dels propietaris que participen en la votaci\u00f3 (presencials, representats o per delegaci\u00f3).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Consideracions legals finals<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Execuci\u00f3 immediata de l&#8217;acord<\/h3>\n\n\n\n<p>Els acords adoptats per la Junta de Propietaris s\u00f3n obligatoris i vinculen a tots els propietaris,<br>fins i tot als dissidents. Generalment s\u00f3n executius des del moment en que s&#8217;adopten, tret que els<br>estatuts de la comunitat disposin expressament el contrari.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Dret a impugnar el cessament<\/h3>\n\n\n\n<p>Qualsevol propietari que hagi votat en contra o els absents que s&#8217;oposin formalment poden impugnar<br>l&#8217;acord judicialment si consideren que \u00e9s contrari a la llei o als estatuts de la comunitat.<\/p>\n\n\n\n<p><strong>Termini per impugnar:<\/strong> <\/p>\n\n\n\n<p><strong>Un any:<\/strong> Si l&#8217;acord \u00e9s contrari a la llei o als estatuts.<\/p>\n\n\n\n<p><strong>Tres mesos:<\/strong> Si l&#8217;acord \u00e9s contrari als interessos de la comunitat o greument perjudicial per a un propietari. <\/p>\n\n\n\n<p><strong>Important:<\/strong> La impugnaci\u00f3 <strong>NO susp\u00e8n autom\u00e0ticament<\/strong> l&#8217;execuci\u00f3 del cessament. L&#8217;administrador se&#8217;n<br>va el dia acordat. Si posteriorment la impugnaci\u00f3 prospera, pot reclamar danys i perjudicis.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Cl\u00e0usules indemnitzat\u00f2ries del contracte<\/h3>\n\n\n\n<p>Abans de realitzar el cessament, <strong>revisa el contracte<\/strong> signat amb l&#8217;administrador per verificar si hi ha<br>cl\u00e1usules de indemnitzaci\u00f3 per rescissi\u00f3 anticipada sense justa causa.<\/p>\n\n\n\n<p>Malgrat que el Codi Civil de Catalunya permet la remoci\u00f3 per la Junta de Propietaris, els compromisos<br>contractuals privats podrien generar obligacions econ\u00f2miques addicionals per a la comunitat.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Preguntes freq\u00fcents<\/h2>\n\n\n\n<p><strong>P: Quina majoria es necessita per cessar l&#8217;administrador segons el Codi Civil de Catalunya?<\/strong><br>R: Majoria simple. Ha de conservar les convocat\u00f2ries i documentaci\u00f3 comptable durant<br>m\u00ednim cinc anys, i el llibre d&#8217;actes durant trenta anys mentre existeixi la comunitat.<\/p>\n\n\n\n<p><strong>P: Quins documents ha de lliurar obligat\u00f2riament l&#8217;administrador sortint?<\/strong><br>R: Convocat\u00f2ries, actes de junta, p\u00f2lisses d&#8217;asseguran\u00e7a, presupuestos anuals, documentaci\u00f3 comptable,<br>registre de morosos, contractes amb proveedors (ascensor, llum, gas), i qualsevol altra documentaci\u00f3<br>que custodi per a la comunitat.<\/p>\n\n\n\n<p><strong>P: Pot l&#8217;administrador retenir documentaci\u00f3 si no est\u00e0 d&#8217;acord amb el <strong>cessament<\/strong>?<\/strong><br>R: No. La retenci\u00f3 de documentaci\u00f3 \u00e9s il\u00b7legal.
